By accessing and using ProductPhoto AI (the "Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

ProductPhoto AI provides AI-powered image generation services for product photography. The Service allows users to upload product images and generate professional product photos using artificial intelligence technology.

3. User Accounts and Credits

3.1 Account Registration: You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Credits System: The Service operates on a credit-based system. Each image generation consumes credits from your account. Credits are non-refundable once purchased.

3.3 Credit Expiration: Credits do not expire and remain valid indefinitely unless your account is terminated.

4. Intellectual Property Rights

4.1 User Content: You retain all rights to the original product images you upload to the Service.

4.2 Generated Images: All images generated by the Service are owned by you. You have full commercial rights to use, modify, and distribute the generated images without attribution.

4.3 Service Technology: All intellectual property rights in the Service, including but not limited to software, algorithms, and AI models, remain the exclusive property of loehn.digital GmbH.

5. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or offensive content
• Infringe upon the intellectual property rights of others
• Upload images containing personal data of third parties without consent
• Attempt to reverse engineer or compromise the Service's security
• Use automated systems to abuse or overload the Service

6. Service Availability and Quality

6.1 Availability: We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Maintenance, updates, or technical issues may cause temporary unavailability.

6.2 Quality: While we aim to provide high-quality results, AI-generated images may vary in quality. We do not guarantee that every generated image will meet your expectations.

7. File Storage and Retention

7.1 Storage Period: Files generated by productPhotoAI are guaranteed to be available for at least 7 days from the date of generation. After this period, files may be deleted at any time to manage storage capacity and system resources.

7.2 User Responsibility: You are solely responsible for downloading and storing any generated images you wish to keep beyond the guaranteed retention period. We are not liable for any loss of generated content after the 7-day guarantee period.

7.3 Download Capability: The Service provides download functionality for all generated images. We recommend downloading files promptly and maintaining your own backups of important content.

8. Limitation of Liability

To the maximum extent permitted by law, loehn.digital GmbH shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from use or inability to use the Service
• Any content generated by the Service or actions taken based on such content

Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless loehn.digital GmbH, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Data Protection

Your use of the Service is also governed by our Privacy Policy. We process your personal data in accordance with applicable data protection laws, including the GDPR.

11. Termination

11.1 By You: You may terminate your account at any time. Unused credits will be forfeited upon termination.

11.2 By Us: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or abusive behavior.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Munich, Germany.
